Terms of Service

1. Acceptance of terms

By creating a Faiyr account, downloading the app, or using any part of the Faiyr service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use Faiyr.

These Terms form a legal agreement between you and Birch Digital Inc. ("Faiyr", "we", "us"), a company incorporated in British Columbia, Canada, with offices at Birch Digital Inc., 264‑329 Howe St, Vancouver, BC, Canada.

2. The service

Faiyr provides a group expense-tracking and balance-management platform available via iOS app, Android app, and web browser. The service allows users to create groups, log shared expenses, track balances, and record payments.

Faiyr is a tracking tool only. We do not process, hold, transmit, or facilitate any payments between users. All financial settlements occur directly between users through their chosen payment methods (e.g., cash, bank transfer, peer-to-peer payment apps). Faiyr has no involvement in those transactions and accepts no liability for them.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice to active users.

3. Accounts

You must be at least 13 years old (16 in the EEA) to create a Faiyr account. By registering, you confirm you meet this age requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@faiyr.app if you suspect unauthorized access.

You may not create accounts for others without their knowledge, share your account, or impersonate other individuals.

4. Acceptable use

You agree not to:

Use Faiyr for any unlawful purpose or in violation of any applicable laws or regulations.
Attempt to gain unauthorized access to our systems, other users' accounts, or any data not belonging to you.
Introduce malware, viruses, or any harmful code.
Reverse-engineer, decompile, or otherwise attempt to extract source code from Faiyr.
Harass, abuse, or harm other users.
Use Faiyr to track, monitor, or access data belonging to individuals without their consent.
Circumvent any rate limits, security measures, or technical restrictions.
Resell, sublicense, or commercialize access to the service without our prior written consent.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice, depending on the severity of the violation.

5. Subscriptions and billing

Free tier

Faiyr offers a free tier with limited functionality. No payment information is required to use the free tier.

Faiyr Pro

Faiyr Pro is a paid subscription that unlocks additional features. Subscription pricing is displayed in the app at the time of purchase and may vary by region and platform.

Billing

Subscriptions are billed through the Apple App Store or Google Play Store. Billing, refund, and cancellation terms are governed by the respective platform's policies. We do not directly process payment card information.

Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Your Pro access continues until the end of the current billing period. We do not offer pro-rated refunds for partial periods.

Refunds

Refund requests are handled by Apple or Google in accordance with their policies. For exceptional circumstances, contact us at hello@faiyr.app and we will do our best to assist.

Price changes

We may change subscription pricing at any time. Existing subscribers will be notified at least 30 days in advance of any price increase and will have the opportunity to cancel before the new price takes effect.

6. Your data

You retain ownership of all content you submit to Faiyr (expenses, descriptions, payment records). By using Faiyr, you grant us a limited, non-exclusive licence to store, process, and display that content as necessary to provide the service.

We do not claim ownership of your data, and we do not use your financial transaction records for advertising or sale to third parties. See our Privacy Policy for full details on how we handle your data.

You may export your data at any time via Settings → Export My Data, and you may permanently delete your account and all associated data via Settings → Delete Account.

7. Intellectual property

All Faiyr software, design, trademarks, and brand assets are the property of Birch Digital Inc. and are protected by applicable intellectual property laws. Nothing in these Terms grants you a licence to use our trademarks or brand assets without our prior written consent.

8. Termination

You may delete your account at any time. We may suspend or terminate your access at any time if you breach these Terms, if required by law, or for operational reasons, with or without notice depending on the circumstances.

On termination, your right to use Faiyr ceases immediately. Sections 7, 9, 10, and 11 survive termination.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that Faiyr will be uninterrupted, error-free, or free of harmful components. We are not responsible for any disputes, losses, or claims arising between users as a result of financial transactions they conduct outside of Faiyr.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIRCH DIGITAL INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF FAIYR.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL SUBSCRIPTION FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) CAD $50.

Some jurisdictions do not allow limitations on implied warranties or incidental damages, so the above limitations may not apply to you.

11. Governing law

These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of British Columbia for any dispute arising out of these Terms, unless consumer protection laws in your jurisdiction require otherwise.

12. Changes to these terms

We may update these Terms at any time. When we make material changes, we will update the effective date above and notify active users via email or in-app notification at least 14 days before the changes take effect. Your continued use of Faiyr after that date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using Faiyr and may delete your account before the new Terms take effect.
